On 30 June 2021 the Authority cancelled the registration of migration agent Teng ZHAO (MARN: 1577086) following an investigation into three complaints in relation to the Agent’s conduct.
The Authority found that the Agent:
o Did not act in accordance with the law by being party to a fraud which resulted in the provision of false and misleading statements and documentation to the Department in relation to a number of applications;
o Attempted to mislead the Authority during the course of its investigation into his conduct;
o Acted in a dishonest and deceitful manner and has not taken responsibility for his actions;
o Not declared immigration assistance in a significant number of visa and nomination applications to avoid scrutiny and investigation;
o Failed to exercise or deliberately disregarded his professional obligations as a registered migration agent to his clients, the Department and the Authority;
o Breached the Code with respect to multiple counts of serious conduct where the behaviour involves an element of fraud; and
o Failed to consider the reputational damage to the profession and brought the migration agent profession into disrepute.
The Authority was satisfied that the Agent was in breach of clauses 2.1, 2.9, 2.9A, 2.23, 3.1, 3.2, 5.1, 5.5, 7.2 and 7.4 of the Code of Conduct for Registered Migration Agents and was not a person of integrity and not a fit and proper person to provide immigration assistance.
