求教郑玉桂律师一个问题，关于开车用手机gps

今开车时候用手机gps，手机放在显示油表的地方，转弯时候，手机翻过来了，于是，等红灯的时候，就把它拿起来，然后翻回去，放到那里。一会下个红灯时候，警察过来敲窗户，我赶忙说是手机gps，他也看到手机屏幕上是gps，就在前面放着的，但是他还是让我前面停在路边。然后开罚单，我又对他说这是手机gps，他说这是电话，他看到我拿起来了，我说你应该看到我只用gps了，他说他看到我拿起来了然后继续看我驾照，给我开罚单。我说你应该写上我只用gps，他写上“我自己说是只用的手机gps，”我说你应该写上你看到了，他拒绝，然后我说我不签字，他说，you don't have to，然后给我罚单放到车上，开车走了。     我没有用耳机，没有把手机贴到脸上， 就拿起来然后放正，放到前面，这就被罚款，感觉太冤了。 想请问郑律师，我这种可以申诉吗？有必要吗？

我也被罚了360，他主要就是说你拿了，拿了就是TOUCH了
