如果你的汽车是停在停车场以外的停车位而被其它汽车倒车的时候刮花的话，因你不是停在停车场指定的停车位，因此你是需要负起一部分的责任的。而对方倒车的时候刮花了你的车也需要负起一部分责任。但是衡量责任的比例，对方的责任是比较高的。因此我认为对方需要负起百分之七十，而你需要负百分之三十。当然要视乎当时你停泊的位置是否死角位，还是在别人倒车时容易刮花的地方。

整体来说，如果你的汽车是停定的状态，对方倒车而刮花你，对方是要负起大部分的责任的。就算你停在非停车位上，对方还需要负起七成的责任。除非你能够绘一个图，向本律师告知清楚有关当时的位置，否则很难给你一个确实的法律意见。

时间是晚上10点左右  
我的车在非标准位
深红色
露天停车场 有路灯 （不知道难以看见 算不算事故理由）
停的不够远 理论上 别的车在退后倒出的时候 不注意就可能会碰到， 小心注意一点 也是可以避免的

我相当同情你的遭遇。依据你所提供的补充资料，这些都是负面的因素，其中包括：

1.刮花的时间是晚上10点左右。
2.你的车在非标准位停泊。
3.是露天停车场，有路灯，因为照明不太充足，很难看到你的汽车。
   一个正常的驾驶者，会预计后面是没有汽车的。
4.你停得不够远，因此后倒的车是很容易撞到你的汽车。
