我是163商业移民， 08年10月登陆澳洲，到今天已满足居住一年 经营生意2年的申请PR条件 因我两年间有两次回国接近3个月 我现在的移民律师说我将不符合每次离境不超过6周的规定 他之前并没有告知我这些 致使我现在要从头算  请您帮忙解答一下  有没有这个限定 具体怎样 我是否要重新居住一年的时间 是不是从第2次离境回来算起吗？

我相当同情你的际遇，可能你第一次来澳洲的时候，你的移民律师没有向你详细解释有关你163转永居的先决条件。
根据过往的移民惯例，任何163的人士必须在指定限期内在南澳州经营生意2年。申请转永居前1年必须在澳洲居住，以证实你是在澳洲有直接参与你的生意的经营运作。
而该居住1年内是没有明文规定不可以离开澳洲的，但是如果离开澳洲太长时间，那么证明你有参与生意上的运作是有一定的困难。
如果你在申请前12个月离开超过6周的话，你还可以申请的，主要条件是你要证明回中国是你生意上的实际需要，比如办货、市场推广等等。
