我家的房子正在卖，上个月有买家要买然后签了合同还付10000AUD DEPOSIT。然后今天AGENT打给我说买家贷款遇到情况，批不出来。然后我跟他讲那他付的DEPOSIT是不是不还给他的了，然后AGENT说DEPOSIT要REFUND给他的因为他有贷款。请问这是真的吗？因为他说买房子，我CONVEYANCER那里已经付钱了，后面他又不买，那我付给CONVEYANCER的钱不是亏了？所以我觉得很困惑那个DEPOSIT是不是要给我们的。

如果合约注明subject to finance, 买方有银行证明不提供贷款，卖方必须退还定金。这是很普遍的條款。
