以下说几个最突出的问题:
1. Failed to change the settlement day after making guaranteein this case.
At the beginning when I told LM I intended to change the settlement date ahead to 28th, Nov, 2008. They promised me that they could arrange it.
本来说好可以帮我把我的settlement日期提前,但是后来又通知我不能改了,并且是眼看就要到settlement的日期了,留给我准备的时间很少。
2. Failed to effectively respond to client’s enquiries during the service period due to unprofessionally conducting thebusiness as a second job.
(Lincoln and Monica are the owners of the LMConveyancing, they also got another formal job. They treated my convenyancing deal very casually.)
因为这家所谓的conveyancing公司其实就二个人,他们俩还都有正式工作,只是把这个conveyancing做为副业,平时跟本不上心,打电话只好留言,回复也很晚。
3. Failed to inform about the building insurance informationfrom section 32, caused trouble for client to double spend the insurance cost.(When I asked them whether I need to buy a building insurance from a third party insurance company, they told me it was necessary. But actually my unit already got insuranced as a party of build corp with Roderick Insurance)
一开始问他我要不要买building保险,他说你要买。我就买了,后来银行的人告诉我我的合同里包括了一份building corp,在买房的时候房子保险就以经保给第三方保险公司,我无需再另买保险的。
4. Failed to calculate the right amount of Property Transfer Stamp Duty in the first place due to the lake of professional knowledge and careless. Inform the purchaser the adjustment letter on a very late timing. (They didnt' calculate the stamp duty at all, and they sent the adjustment letter to me at 28, Nov 2008 afternoon, but my settlement date was next Monday.)
给我算的adjustment也不对,并且stamp duty这部份跟本就没有算!!并且我下周一settlement,他们上个周五上午才把这份adjustment report发到我的邮箱,让我在非常有限的时间里去准备所有的settlement的事。
5. Failed to carry the duty during the final Conveyancingprocess by giving me wrong information. Lincoln told me to do nothing one business day before the settlement date, and only found out he was wrong when he was told by customer and broker. It could cause serious
trouble if I followed Lincoln’s advice for doing nothing.
这是更可气的,在周五还对我讲你不需要issue cheque,也不要做任何事。我不放心去问了银行。银行说你需要马上把钱从另一家银行转过来。那时以经周五了,下周一就要settlement了(好在银行的人提醒了,要不然settlement就完蛋了!!)这时电汇以经不可能了,只好大中午的跟公司说我去办别的事情,利用中午吃饭的时间跑到另一家银行买了一个telegraphic transfer.
Settlement以后我说你们服务这么不好,我在settlement遇到这么多麻烦,是不是可以给我一个reinbursement.他们说他们会考虑。然后又在电邮里通知我说你的settlement是很顺利的,我们不会给你reinbursement。接着五天之后对方的solicitor就发信说你欠这家conveyingX钱,加上现在的legal cost,一共是X+220块。7天内不把所有的钱交齐就上法庭。。我晕死了,他们服务这么差,为了收钱还找了个律师说是我欠他们服务费,我从来就没有说不给他们服务费,但是他们的服务真是够差。我只想他们能给我一个合理的解释。做为消费者,我感觉我就是所识非人,被这种无赖公司blackmail咬上了。有人懂法律么?能给一些法律建议么?我以经去consumer affair dept去投诉他们了。我说的事情都是实情,我都有solid proof..
