殴打是刑事起诉的程序，警方会考虑殴打的理由及严重性，而起诉。一般殴打并没有受伤的话，会被刑事起诉殴打。但是如果有人受伤或者需要送医院留医的话，则会升级为刑事伤害他人罪，那么就会比较严重一点。
另外一个理据就是，警方起诉哪个人是根据哪个人的伤势比较严重。
在一般的情况下，警方都会根据多种因素，然后再决定刑事起诉哪个人的。
被刑事起诉殴打的话，一经定罪，便会留有案底。这个会影响将来学生续签或移民。
