Thank you for your application submitted under the Skilled Worker
class. This application was received when the former Canadian
Immigration legislation (Immigration Act, 1976 and Immigration
Regulations, 1978) was in effect. However, on June 28,2002new
Canadian Immigration legislation was implemented entitled the
Immigration and Refugee Protection Act (‘IRPA’) and the
Immigration and Regulation Protection Regulations.
As a result, section 201of IRPA states that the regulations may
provide for measures regarding the transition between the former Act
and this Act. Subsection 361(5) of the Immigration and Refugee
Protection Regulations, 2002,provides that if a foreign national
referred to in paragraph (2)(a) made an application before January
1,2002 for an immigrant visa and has not, before April 1,2003,been
awarded the number of units of assessment required by the former
Regulations, they must obtain a minimum of 70points based on the
factors set out in paragraph 76(1)(a) of the new Regulations to
become a permanent resident of the federal skilled worker class.
The purpose of this letter is to advise you that your application
did not receive a selection decision prior to April 1,2003and will
therefore be assessed under the new RPA selection criteria. You may

In order for us to assess your application under the IRPA selection
criteria, you are required to complete an updated application former
(enclosed), submit proof of your current level of language
proficiency (see reverse of this letter for definition of proof of
language proficiency), and return it within 90 days from the date of
this letter. If your file already contains recent proof of your
current level of language proficiency, there is no need to resubmit
proof; simply submit completed application form only. No other
documents are required at this time.
If you fail to submit updated ination and/or documents within
90days, your application will be assessed on the basis of the
information on file and therefore it may be refused with no further
notice.
